Current developments in the area of international investment law are in the focus of the event organised by Prof Irmgard Marboe of the Department of European, International and Comparative Law at the University of Vienna, together with the Instituto de Investigaciones Jurídicas of the Universidad Nacional Autónoma de México and Wöss & Partners. The political and economic turbulences in Latin-America and numerous arbitration cases against Latin-American states have led to controversies about international investment law in that region. However, the discussions are different in various countries. While some Latin-American states withdrew from ICSID, the World Bank’s International Centre for Settlement of Investment Disputes, Mexico is preparing to ratify the ICSID Convention.
In this context, the event will address the question to what extent experiences from the numerous arbitration cases against Latin-American states may bring insights for the discussion in Europe about the protection of foreign investors. This will be analysed particularly in regard to the calculation of damages, as especially investors’ damages claims are often criticised.
The Investment Arbitration Forum (Foro de Arbitraje en Materia de Inversión) was founded by Wöss & Partners together with Sonia Rodríguez Jiménez (┼) of the Instituto de Investigaciones Jurídicas of the Universidad Nacional Autónoma de México in 2008 and has since been held annually, usually in Mexico City, but also in Washington, D.C. Two publications have been published, which are also available online (https://biblio.juridicas.unam.mx/bjv/detalle-libro/3386-foro-de-arbitraje-en-materia-de-inversion). The event at the Viennese Juridicum will be the first time that it will be held in Europe.
