Should non-material damages be awarded on the basis of the GDPR, even if the claimant has suffered a mere discomfort? This question lies at the heart of the Österreichische Post case (C-300/21), for which the ruling is expected to be published on 4 May 2023. We will discuss the reasoning and consequences of the ECJ’s judgment with data protection experts and lawyers involved in pending proceedings for the award of non-material damages under Art 82 GDPR.
